Gigamon Inc. (“we” or “Gigamon”) recognizes that the European Community has established a data protection regime pursuant to Directive 95/46/EC (the “Directive”). This Directive applies to the European Economic Area ("EEA"). Switzerland has also established a data protection regime pursuant to the Swiss Federal Act on Data Protection. These regimes restrict companies in the EEA and Switzerland (collectively, “EEA/CH”) from transferring personal data about individuals in the EEA/CH to the United States, unless there is "adequate protection" for such personal data when it is received in the United States. To create such "adequate protection" and allow our subsidiaries and business partners to overcome the restriction on international data transfers established by the Directive and the Swiss Federal Act on Data Protection, we adhere to the Safe Harbor Privacy Principles published by US Department of Commerce ("Safe Harbor Principles") with respect to personal data about individuals residing in the EEA/CH that our subsidiaries, branches, customers and other business partners in the EEA/CH provide to Gigamon in the United States (“EEA/CH Data”). This Notice applies only to EEA/CH Data relating to data subjects residing in the EEA/CH ("EEA/CH Persons") whose data we may receive from one of our subsidiaries, customers, suppliers or other business partners in the EEA/CH. It does not apply to personal data that Gigamon receives about employees of Gigamon or our subsidiaries.
We, together with our subsidiaries ("Gigamon Group"), sell intelligent network traffic visibility solutions largely to enterprises, data centers and service providers. We receive mostly business-related information from the EEA/CH, including contact information of individual representatives of the businesses with whom we are dealing, including without limitation, names, addresses, work phone numbers and work email addresses of EEA/CH Persons.
We collect and use EEA/CH Data for purposes of providing products and services to our customers, communicating with corporate business partners about business matters, providing information on our products and services, and conducting related tasks for legitimate business purposes.
We share EEA/CH Data with our subsidiaries, affiliates and contractors, who may process EEA/CH Data on behalf of the Gigamon Group. We may also share EEA/CH Data with other third parties for the purposes for which we receive the EEA/CH Data (e.g., performance of contractual obligations and rights), and we may also disclose EEA/CH Data where we are legally required to do so (e.g., under statutes, contracts or otherwise) or if the disclosure is permitted by law or the Safe Harbor Principles and we have a legitimate business interest in such disclosure.
With respect to marketing emails, EEA/CH Persons may opt-out of receiving further email marketing communications from Gigamon by sending an email to email@example.com, or by following opt-out instructions that are contained in each marketing email.
If you are an EEA/CH Person about whom we hold EEA/CH Data, you may request access to, and the opportunity to update, correct or delete, such EEA/CH Data. To submit such requests, please send an email to firstname.lastname@example.org. We will endeavor to respond in a timely manner to all reasonable requests to view, modify or inactivate the EEA/CH Data. We reserve the right to take appropriate steps to authenticate an applicant's identity before providing access and to deny requests, except as required by the Safe Harbor Principles.
