Privacy Policy for the Community site

Gigamon Inc., 3300 Olcott Street, Santa Clara, CA 95054 (“Gigamon”), acting as a data controller, collects your personal information (“PI”) on its Community site.

You are informed that Gigamon, being a US based company, your personal information will be transferred to the United States for the purposes mentioned below.

Personal Information We Collect  

In the context of the Community site, we will collect, process and use your PI including your identification information, such as your name, the organization for which you work, your position within the organization, country and business email address.

 

Why We Collect Personal Information and How We Use It

We collect and use your PI for the following purposes:

  • to prrocess your registration for the Community site,
  • to administer the Community site and programs,
  • to provide requested services and information (including support and maintenance services if you are a Gigamon customer) and,
  • to respond appropriately to your inquiries.

We carry out the above mentioned processing in accordance with your consent. You are informed that you have the right to withdraw your consent at any time (without calling into question the processing previously carried out) by writing to privacy@gigamon.com.

Subject to your consent, we may also use your email address to send you information on promotions and events. If you do not wish to receive such marketing emails anymore, you may withdraw your consent at any time (without calling into question the processing previously carried out) by writing to privacy@gigamon.com or by following opt-out instructions included in such emails.

 

Who May Have Access To Your Personal Information

Your PI may be shared with affiliates and third parties, in particular:  

i. our group of companies for the purpose of providing marketing communications and support and maintenance. 

Such disclosures may involve transferring your personal data out of the European Union to the following country: United States and India. These transfers are carried out in the framework of Standard Contractual Clauses adopted by the European Commission. You may obtain a copy by writing to privacy@gigamon.com.  

our third-party service providers, who act on our behalf to fulfill product orders, deliver services, and business partners, such as system integrators, so they can provide you with information you have requested on a product or service, under our instructions and with appropriate confidentiality and exclusivity.Such disclosures may involve transferring your personal data out of the European Union to the following country: United States. These transfers are carried out in the framework of Standard Contractual Clauses adopted by the European Commission. You may obtain a copy by writing to privacy@gigamon.com.  

ii. regulators and government authorities if we are required to do so by law and courts and public authorities in order to protect you, us, or third parties from harm, including fraud or instances where somebody’s physical safety is at risk.

 

Record Retention Practices

Gigamon will retain PI no longer than is necessary to carry out the purposes described here. 

If you are already a Gigamon customer, we keep your PI during the duration of your contract with us. If you are not, we keep your data in accordance with our retention policy.

Any PI retained will be processed, used, disclosed, and stored in accordance with this notice. Gigamon uses advanced technology and well-defined practices, as required by applicable law, to help protect your PI from unauthorized access, use, misuse, modification, disclosure and destruction. 

 

Your Rights Regarding Your Personal Information

Under applicable law, you may have certain rights in relation to your PI, including the right to make certain requests. These rights differ by country. If you are in Europe, the EEA or Switzerland, your rights can be summarized in broad terms as follows:

  • Right of Access: You have the right to confirm with us whether your PI has been processed, and, if it has been, to request access (including to the categories of PI processed, the purpose of the processing and the recipients or categories of recipients). We do have to take into account the interests of others though and if you want to request more than one copy we may charge a fee. 
  • Right to rectification: You may have the right to rectify inaccurate or incomplete PI concerning you. 
  • Right to erasure (right to be forgotten): In limited circumstances, you may have the right to ask us to erase PI concerning you. 
  • Right to restriction of processing: In limited circumstances, you may have the right to request that we restrict processing of your PI. 
  • Right to data portability: You may have the right to receive PI concerning you, which you have provided to us, in a structured, commonly used and machine-readable format and you may have the right to transmit that PI to another entity. 
  • Right to object and rights relating to automated decision-making: Under certain circumstances, you may have the right to object to the processing of your PI, including profiling, by us and we may be required to stop processing your PI.
